By accessing and using Kevin Builds Brands ("we," "our," or "us") brand audit services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services

Kevin Builds Brands provides professional brand analysis and strategic consulting services, including:

• Website and platform analysis
• Brand health assessments and scoring
• Strategic recommendations and action plans
• Professional PDF reports
• Live competitor intelligence and visual critique
• 1-on-1 consulting (separate engagement, by application)

3. User Responsibilities

Account Information

You are responsible for maintaining the accuracy of information provided during the audit process, including website URLs, business details, and contact information.

Website Access

You must ensure that your website is publicly accessible and not behind authentication or paywalls that would prevent analysis. We analyze only publicly available information.

Compliance

You agree to use our services in compliance with all applicable laws and regulations. You must not provide false or misleading information.

4. Payment Terms

Pricing and Payment

All fees are listed in USD and are subject to change. Payment is processed through Stripe and is due at the time of purchase. We reserve the right to modify pricing with 30 days notice.

Refunds

Because the audit is a digital report delivered instantly and yours to keep, all sales are final. If something is genuinely wrong with your report, write to kevin@kevinbuildsbrands.com and we will make it right case by case.

1-on-1 consulting is a separate engagement with its own terms, agreed in writing before any work begins.

Late Payments

All payments are processed immediately through our secure payment processor. No late fees apply as all services are delivered digitally upon payment confirmation.

5. Service Delivery

Timeline

Brand audit reports are delivered in minutes, usually under two, of purchase. Consultation calls are scheduled via a booking link sent after audit delivery and typically take place within 1 week of that booking link. Delays may occur due to high demand or technical issues; in such cases we will notify you by email.

Quality Assurance

Audits combine AI analysis with review by Kevin before delivery. We strive for accuracy and specificity but cannot guarantee specific business outcomes.

Revisions

Minor clarifications and follow-up questions are included in all plans. Major revisions or additional analysis may incur additional fees.

6. Intellectual Property

Our Content

All reports, methodologies, and materials provided by Kevin Builds Brands remain our intellectual property. You may use the insights and recommendations for your business but may not reproduce or distribute our reports without permission.

Your Content

You retain ownership of your website content, brand materials, and business information provided during the audit process.

7. Confidentiality

We treat your business information confidentially and do not share specific details with third parties without your permission. However, we may use anonymized insights for marketing purposes (such as case studies) unless you specifically request otherwise.

8. Limitation of Liability

Our services provide strategic analysis and recommendations based on available data. While we strive for accuracy, we cannot guarantee specific business results or outcomes. Our liability is limited to the amount paid for our services. We are not liable for indirect, incidental, or consequential damages.

No Guarantee of Results

Brand strategy is complex and results depend on many factors including implementation, market conditions, and competition. We provide analysis and recommendations but cannot guarantee specific outcomes.

Third-Party Platforms

Our analysis may reference third-party platforms (Shopify, WooCommerce, etc.). We are not affiliated with these platforms and our recommendations are based on general best practices.

AI-Generated Content

Our reports incorporate AI analysis tools. While all content is reviewed by human experts, AI systems may occasionally produce imperfect results. We continuously improve our methodologies.

10. Termination

Either party may terminate this agreement at any time. Upon termination, you will retain access to any reports delivered prior to termination. Refunds will be provided according to our refund policy.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law provisions. Any disputes will be resolved through binding arbitration administered by the American Arbitration Association, seated in Virginia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of our services constitutes acceptance of updated Terms.
